[rCable] Is Start advocating against rCable Upload throttling

So I switched to start to get a better upload speed. I've switched backup providers and I'm pretty aggressive about keeping good backups. I figure it will take me several weeks and then I'll be caught up. I had trouble with 50% speeds. Having done a lot of trouble shooting over the last few weeks with start which included several phone calls, 2 rogers tech visits and modem swap the Start representative told me on the phone Rogers put a note on my file that I was part of the new throttling protocol. It was good to get this confirmed, a little frustrating and waste of resources it wasn't identified sooner. (I suspected I was being throttled after reading some Teksavvy experiences on Reddit and I did make a post on the DSLReports Teksavvy to see if others were affected and it does seem to affect a few). As a side note, I found the start staff competent in their troubleshooting and did seem to go the extra mile in collecting extra data from me to make strong tickets for Rogers to review. When the throttling is triggered, it is a passive 4 day switch that gets flipped. When I realized throttling was a possibility I did change my habits to shut things off before supper so as not to interfere with peak times. Based on the questions from the tech it sounds like streamers can push out enough data to activate the throttle. Something a little less arbitrary or that is implemented during times of actual congestion would make more sense to me. (I doubt my uploading at 4 AM hurts the network.... I could maybe see an argument for uploading straight from 7-9 causing trouble where infrastructure is weaker). My question is, is Start advocating at any level about the throttling?
